1 - Introduction

1.1. By accessing or using the MYTHSOFT TECH LTDA website and/or registering an account for the game "Mythera74", you agree to these Terms of Service and all game policies and regulations, including our Privacy Policy and specific rules. By creating an account and/or downloading the game software, you confirm and warrant that you are at least 18 years of age.

1.2. This document sets out the terms under which MYTHSOFT TECH LTDA provides access to an account for you to play the online RPG "Mythera74".

1.3. If you do not agree with these Terms, do not use the "Mythera74" website or game. Acceptance or continued use of the site or game implies unrestricted acceptance, even tacit, of all the terms and conditions described below.

1.4. These Terms may be updated by MYTHSOFT TECH LTDA due to changes in applicable law, regulatory requirements, or by its own decision. The updated version will be available on the website, and continued use of the game or website after changes will constitute acceptance of those changes.

2 - Age Restriction and Eligibility

2.1. MINIMUM AGE REQUIREMENT: "Mythera74" requires users to be at least 18 years of age. By creating an account, accessing the website, or using any of our services, you declare and warrant that you are at least 18 years old.

2.2. PROHIBITION FOR CHILDREN UNDER 18: Access to "Mythera74" by individuals under 18 years of age is strictly prohibited.

2.4. MATURE CONTENT (18+): Certain features of "Mythera74" contain mature content and are restricted to users aged 18 years or older. These include but are not limited to: (a) certain in-game areas with adult themes. Users under 18 will be automatically blocked from accessing these areas.

2.6. CONTENT NATURE: "Mythera74" contains elements that parents should be aware of, including but not limited to: (a) fantasy violence and combat themes; (b) in-game chat and social interaction with other players; (c) virtual economy with optional real-money transactions.

2.7. IMMEDIATE ACCOUNT TERMINATION FOR MINORS: If MYTHSOFT TECH LTDA identifies or suspects that an account belongs to or is being used by an individual under 18 years of age, the account will be immediately and permanently terminated without prior notice. All virtual items, currency, progress, and any funds associated with the account will be forfeited without right to refund or compensation.

2.8. AGE VERIFICATION: MYTHSOFT TECH LTDA may, at any time and at its sole discretion, request documentation to verify the user's age. Failure to provide such documentation or providing false information may result in immediate account suspension or permanent termination without right to refund.

2.9. FALSE DECLARATION: Providing false information about age during registration or at any other time constitutes a serious violation of these Terms and may result in: (a) immediate and permanent account termination; (b) forfeiture of all virtual items, currency, and progress; (c) legal action as permitted by applicable law.

2.10. PARENTAL RESPONSIBILITY: Parents and legal guardians are responsible for supervising minors under their care when using "Mythera74". MYTHSOFT TECH LTDA strongly recommends the use of parental control software and supervision of children's online activities.

2.11. COMPULSIVE USE WARNING: Prolonged exposure to video games may cause adverse effects on physical and mental health. We recommend taking regular breaks, maintaining healthy gaming habits, and seeking professional help if you or someone you know shows signs of gaming addiction. Users under 18 are automatically subject to playing time limits to help prevent compulsive use.

3 - Disclaimer of Liability

3.1. The game "Mythera74" is provided "as is", with no guarantees of continuous operation, absence of errors, or vulnerabilities. MYTHSOFT TECH LTDA offers no express or implied warranties of any kind, including but not limited to warranties of title, compliance, merchantability, or fitness for a particular purpose.

3.2. The use of the software is at your sole responsibility. MYTHSOFT TECH LTDA does not guarantee that the software, the game, or your account will function uninterrupted, error-free, securely, or free from viruses.

3.3. MYTHSOFT TECH LTDA is not responsible for unforeseeable events or acts of God that interfere with the game, such as technical failures, third-party attacks (e.g., hacking or DDoS), internet service interruptions, or other factors beyond the Company's control.

4 - Limitation of Liability

4.1. MYTHSOFT TECH LTDA is not liable for any loss of profits, data, special, incidental, or consequential damages arising from the use or inability to use the game, including the loss of items, accounts, or characters due to errors, system maintenance, or gameplay changes.

4.2. In accordance with Article 927 of the Brazilian Civil Code, MYTHSOFT TECH LTDA's liability for damages only applies in cases of intent or gross negligence, which do not fall within the nature of the service provided. The user assumes all risks inherent in the use of the game.

5 - User Obligations

5.1. The user must comply with all "Mythera74" rules, available on the official game website. Failure to comply with these rules may result in account suspension or deletion, with no right to refund or compensation. The user's contractual obligations are subject to Articles 421 and 422 of the Brazilian Civil Code, which deal with the principles of good faith and the social function of the contract.

6 - Data Protection and Privacy

6.1. MYTHSOFT TECH LTDA treats users' personal data in accordance with applicable Brazilian data protection legislation, including the Brazilian General Data Protection Law (LGPD - Law No. 13,709/2018), to the extent applicable to its activities.

Users' personal data may be collected, stored, and processed for purposes related to account creation, authentication, game operation, customer support, fraud prevention, security, payment processing, compliance with legal obligations, and improvement of the Mythera74 experience.

6.2. The user acknowledges that Mythera74 may use third-party service providers for infrastructure, hosting, security, analytics, payment processing, communication, and customer support. As part of the operation of the service, users' personal data may be stored, processed, or accessed outside Brazil, including in the United States of America.

MYTHSOFT TECH LTDA will seek to use providers and technical, contractual, and organizational measures compatible with applicable data protection legislation.

6.3. MYTHSOFT TECH LTDA adopts reasonable technical and organizational security measures to protect users' personal data against unauthorized access, accidental or unlawful destruction, loss, alteration, disclosure, or any form of improper processing.

6.4. MYTHSOFT TECH LTDA shall not be liable for damages resulting exclusively from security incidents caused by third parties, force majeure, or the user's own negligence, including but not limited to sharing passwords, using weak credentials, reusing passwords from other services, installing malicious software, or failing to protect their access credentials, as provided under Article 43 of the LGPD.

6.5. NO COLLECTION OF MINORS' DATA: Mythera74 is intended only for users who are at least 18 years old. MYTHSOFT TECH LTDA does not knowingly collect, store, or process personal data from minors.

In compliance with Article 14 of the LGPD and applicable Brazilian legislation regarding the protection of children and adolescents in digital environments, including Law No. 15,211/2025 where applicable, if MYTHSOFT TECH LTDA becomes aware that personal data has been collected from an individual under 18 years of age, such data may be deleted and the associated account may be suspended or permanently terminated.

6.6. Users may contact MYTHSOFT TECH LTDA to request information, correction, deletion, or other rights related to their personal data, according to applicable law, through the official support channel provided on the Mythera74 website.

7 - Conflict Resolution

7.1. MYTHSOFT TECH LTDA does not commit to participating in conciliation, mediation, or arbitration procedures outside of the Judiciary. Any disputes arising from these Terms will be resolved in the Court of Curitiba/PR, and the parties expressly waive any other jurisdiction, however privileged.

8 - Final Provisions

8.1. By creating an account or using the website, the user agrees to the "Mythera74" Terms of Service and End User License Agreement.

8.2. These Terms represent the entire agreement between the parties and supersede any other agreement, verbal or written, regarding the use of the game "Mythera74" and the services offered.

8.3. MYTHSOFT TECH LTDA reserves the right to take legal action in the event of non-compliance with these Terms by the user.

9 - Legal Notice

9.1. The game "Mythera74" is an entertainment service, and the user acknowledges that any loss or damage arising from the use of the game cannot be attributed to MYTHSOFT TECH LTDA or its operators.

9.2. All users fully accept the risks associated with the use of the service, expressly waiving any claim for compensation against MYTHSOFT TECH LTDA, its representatives, or partners.

9.3. AGE CLASSIFICATION: "Mythera74" is classified for users aged 18 years and older. This classification is prominently displayed at the time of access and throughout the platform, in compliance with Article 8, V of Law No. 15.211/2025.
