1 - Introduction
1.1. By accessing or using the MYTHSOFT TECH LTDA website, creating an account, downloading the game software, or accessing the online RPG "Mythera74", you agree to these Terms of Service, the Privacy Policy, the Paid Services and Refund Policy, the game rules, and any other policies made available on the official Mythera74 website.
1.2. Mythera74 is intended exclusively for users who are at least 18 years old. By creating an account, accessing the website, downloading the game software, or using the game, you represent and warrant that you are at least 18 years old and legally capable of accepting these Terms.
1.3. This document sets forth the terms under which MYTHSOFT TECH LTDA provides access to an account that allows users to access and play the online RPG "Mythera74", subject to the rules, limitations, technical conditions, and policies described herein.
1.4. If you do not agree to these Terms, you must not access the website, create an account, download the game software, purchase digital products, or use Mythera74. Acceptance of these Terms, account creation, download of the game software, purchase of digital products, or continued use of the website or game constitutes acceptance of all applicable terms and conditions.
1.5. MYTHSOFT TECH LTDA may update these Terms at any time due to changes in applicable law, regulatory requirements, payment provider requirements, security reasons, operational needs, game updates, or by its own decision.
The updated version will be made available on the official Mythera74 website. Continued use of the website, account, game, or paid services after the publication of updated Terms constitutes acceptance of the changes.
1.6. Mythera74 is an online game subject to continuous updates, maintenance, balancing, technical adjustments, security improvements, content changes, economy adjustments, and operational modifications necessary for the stability, security, fairness, and evolution of the game.
2 - Disclaimer of Warranties
2.1. Mythera74, its website, game software, accounts, servers, and related services are provided on an "as is" and "as available" basis, to the maximum extent permitted by applicable law.
MYTHSOFT TECH LTDA will make reasonable efforts to provide a functional, secure, and enjoyable entertainment service, but does not guarantee that the website, game, account, software, servers, or related services will operate uninterruptedly, error-free, vulnerability-free, virus-free, or permanently available.
2.2. The user acknowledges that online games are subject to technical limitations and operational risks, including software bugs, infrastructure failures, internet connection issues, latency, data loss, third-party attacks, unauthorized access attempts, denial-of-service attacks, payment provider failures, hosting provider failures, and other events beyond the reasonable control of MYTHSOFT TECH LTDA.
2.3. MYTHSOFT TECH LTDA is not responsible for events of force majeure, unforeseeable circumstances, third-party actions, internet service disruptions, hosting provider failures, payment provider failures, cyberattacks, DDoS attacks, hacking attempts, malware, user equipment failure, or any other factors beyond its reasonable control that may affect access to the website, account, game, or paid services.
2.4. The user is responsible for maintaining the security of their own device, internet connection, email account, login credentials, password, authentication methods, and any other access information used to access Mythera74.
MYTHSOFT TECH LTDA is not responsible for losses resulting from the user's negligence, account sharing, weak passwords, password reuse, malware, phishing, unauthorized access to the user's email, or failure to protect access credentials.
3 - Limitation of Liability
3.1. The user acknowledges that Mythera74 is an online entertainment service, subject to technical limitations, instability, maintenance, updates, software bugs, balancing changes, rollback events, infrastructure failures, third-party attacks, and other risks inherent to online games.
To the maximum extent permitted by applicable law, MYTHSOFT TECH LTDA shall not be liable for indirect, incidental, special, punitive, moral, material, or consequential damages resulting from the use or inability to use the website, game, account, servers, software, or related services.
This includes, but is not limited to, loss of profits, loss of opportunity, loss of data, loss of access, loss of items, loss of characters, loss of virtual currency, loss of account progress, gameplay changes, balance adjustments, maintenance, bugs, rollback events, or temporary or permanent service interruptions.
3.2. The user acknowledges that Mythera74 is an entertainment service and that virtual items, characters, accounts, Mythera Coins, progress, rankings, and in-game benefits have no real-world monetary value, cannot be exchanged for money, and do not represent property, investment, financial asset, prize, gambling credit, or guaranteed economic benefit.
3.3. Game updates, economy changes, balancing decisions, map changes, monster changes, item changes, skill changes, vocation changes, drop rate changes, experience changes, rollback events, or other gameplay adjustments may occur at any time for technical, operational, balancing, security, anti-cheat, or game design reasons.
Such changes do not generate any right to compensation, refund, indemnification, or replacement, except where required by applicable law or expressly provided in the Refund Policy.
3.4. To the maximum extent permitted by applicable law, MYTHSOFT TECH LTDA's liability for damages arising from the use of the website, game, account, servers, software, or related services shall only apply in cases of proven willful misconduct or gross negligence by MYTHSOFT TECH LTDA.
For the purposes of these Terms, "willful misconduct" means intentional conduct intended to cause damage, and "gross negligence" means manifestly negligent, reckless, or improper conduct, in a high degree, incompatible with the minimum standards of care reasonably expected for the provision of the service.
When legally applicable and duly proven, MYTHSOFT TECH LTDA's liability shall be limited to direct damages effectively caused by MYTHSOFT TECH LTDA, subject to applicable Brazilian law, including the Brazilian Civil Code and the Brazilian Consumer Protection Code.
Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable consumer protection law.
3.5. MYTHSOFT TECH LTDA shall not be responsible for losses, damages, or penalties resulting from violations of the Terms of Use, game rules, anti-cheat rules, payment rules, community rules, account sharing, unauthorized software, bot usage, macro usage, bug abuse, fraud, chargeback abuse, real-money trading, or any conduct prohibited by the official Mythera74 rules.
4 - Account Access and Membership
4.1. Access to Mythera74 is granted through a personal, revocable, limited, non-exclusive, and non-transferable account membership, subject to compliance with these Terms and the official game rules.
4.2. The account remains under the control of MYTHSOFT TECH LTDA and may be suspended, restricted, or terminated in cases of violation of these Terms, security risk, fraud, payment abuse, legal requirement, or conduct harmful to the game, community, company, or other users.
4.3. The user may not sell, rent, lend, share, transfer, assign, commercialize, or otherwise make their account available to third parties, unless expressly authorized by MYTHSOFT TECH LTDA.
4.4. The creation or use of an account does not grant ownership over the game, software, servers, characters, items, maps, content, source code, intellectual property, or any element of Mythera74.
5 - Governing Law and Jurisdiction
5.1. These Terms shall be governed by the laws of Brazil.
5.2. Any disputes arising from these Terms shall be resolved in the courts of Curitiba, State of Paraná, Brazil, with express waiver of any other jurisdiction, except where consumer protection law establishes a mandatory different jurisdiction.
